Our Orange County Bankruptcy Practice
In a Chapter 7 bankruptcy, you agree to sell some of your assets in exchange for the permanent discharge of some types of debt. Under the new bankruptcy laws, however, you must qualify to file a Chapter 7 bankruptcy by submitting to a means test to determine whether you have the ability to repay your creditors over a 3 to 5 year period.
When you come to us for bankruptcy advice, we will walk you through the means test to determine whether you can file under Chapter 7. If you can, we will prepare and submit all the documents necessary to initiate the process. We will also act as your advocate in all proceeding with the court and all interactions with creditors or the bankruptcy trustee. Furthermore, we will make certain you understand which debts, such as student loans, child support arrearages and some taxes, cannot be discharged. We will also confirm that any exempt assets, including principal residence, motor vehicle and retirement assets, are excluded from sale.
